Please read the following Terms and Conditions carefully before placing your order, they contain essential information about your rights and obligations. The following Terms and Conditions apply to all orders made via the Police Pass website. By placing an order, you are agreeing to be bound by these Terms and Conditions of Sale.

                                            
Terms & Conditions for Retail Customers

The seller (Police Pass) reserves the right to improve specifications, alter prices and withdraw and item from sale without notice.

  1. Delivery: please allow 5 - 7 working days for the delivery of any of our products ordered. We will do our utmost to ensure that goods are delivered within the stated time. The Seller (Police Pass) is not responsible for any loss arising from the non-delivery of goods.
  2. Police Pass shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by war or other hostilities, strikes, lockouts, acts of God, accident, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports or any other cause not within the reasonable control of Police Pass.
  3. Returns Policy: In the unlikely event that you receive any of the products purchased in a damaged condition any claim for damage to your order must be made to Police Pass (by written confirmation via e-mail) within 5 working days of receipt of your order. Claims after this period cannot be considered. No claims will be considered unless all the original packaging is retained for inspection by our carrier's representative. Full refunds or exchanges will be made for any items lost or damaged during transit. If the goods are faulty, incorrect or damaged on delivery we will meet the cost of return (we will advise you on how to return the goods) and (at our option) repair, replace or exchange any such goods; or refund you for the price paid including delivery charges.

Persons wishing to cancel a booking for paid revision crammer courses or virtual course more than 14 days before the commencement of the paid course will have the option to either transferring onto an alternative equivalent course at no extra cost or alternatively receiving a refund for the course fee less a cancellation administration fee of £45.00.

Persons wishing to cancel a booking for paid revision crammer courses or virtual course less than 14 days of the paid course will not have the option of a refund and will instead only be permitted to transfer onto an alternative equivalent course at no extra cost.

Persons wishing to return a textbook purchased which is not faulty or damaged must lodge an email request to info@policepass,co.uk within 14 days of the date of dispatch. Refunds will only be considered if the textbook is returned to the Seller at the Purchasers own expense in the same condition as it was dispatched to the Purchaser. The Purchaser will be refunded the cost of the textbook less a postage and administration fee of £10.00. Please note that refunds will not be given if the shrink wrap has been removed from the outside of the crammer books.

Persons who have purchased the NPPF Stage 2 (OSPRE), NIE E-Learning or Promotion Board E-Learning product will be entitled to a full refund bar £45 administrative costs up to 14 days of purchase. No refund will be offered after expiry of the 14-day period of the 6 month licence period.

Promotion Board One to One Support

We will agree a mutually convenient time and date to interact with the client for the one to one support session. This will predominantly take place within office hours Monday to Friday and in any case within 6 months of the original  product purchase. 

Anything outside those hours will be at our sole discretion. We will be entitled to terminate the agreement without any financial redress to the client, in the unlikely event of the one to one session not being delivered through a failure to agree a delivery time.

Secondly, where a client fails to engage at an agreed time and date, for whatever reason, rescheduling will be at our sole discretion and the client understands that a failure to engage at an agreed time and date will result in Police Pass having deemed to have provided the service and thereby discharged their obligations in relation to the purchase of the product.

Police Pass shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by war or other hostilities, strikes, lockouts, acts of God, accident, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports or any other cause not within the reasonable control of Police Pass

360 Feedback Process

Police Pass will deem that the product has been provided to the client at the point where they receive the email communication inviting them to access the platform and commence the process. Police Pass will not be responsible for any delays which may occur in the production of the final report, if clients and their raters  have not undertaken to complete the relevant documentation within 14 days from the purchase of the product.

It is the responsibility of the client and their raters to monitor and access their respective email accounts including spam folders in order to facilitate the production of the report.

Prior to starting the 360 feedback process, it is the responsibility of the client to inform their raters of their desire to receive their feedback and OBTAIN their consent to allow the client to provide their first name, last name and E-mail address in order to provide their feedback within the process. NB. this is important and a requirement under European data protection law, known as the General Data Protection Regulation (GDPR).

Mock Board

We will agree a mutually convenient time and date to interact with the client for the mock board. This will predominantly take place within office hours Monday to Friday. This policy is in addition to any statutory rights you may have as a consumer, which remain unaffected.

  1. Shipping. Shipping is free and is via next-day courier or Royal Mail postal services.
  2. Payment. We accept all major credit / debit cards. Unfortunately, we are unable to process Electron or AMEX cards over the internet. As we do not offer credit facilities, your goods will only be dispatched if we have received the full payment for your order at the time of ordering.
  3. Copyright. All copyright, design and intellectual property rights existing in our designs and products and in the images, text and design of this website / marketing material are and will remain the property of Police Pass (Blue Light Publishing Limited). Any infringement of these rights will be pursued vigorously.
  4. Change of Course Venue. In the unlikely event that a course venue will need to be changed for any reason Police Pass will make all efforts to keep the new location to a reasonable distance from the original venue location.

Supply and licence terms

This document and the order confirmation sets out the terms and conditions for the supply and licence of Products (as defined below) which apply to all customers who deal with the Licensor (as defined below) in the course of their business. These Terms apply to all orders for Products (as defined below) as accepted by Licensor on or after 1st November 2010.

Definitions

"Licence” means the rights licensed from us to you for your use of the Products in accordance with Part B of these Terms;


"you" / "your” means the organisation or individual specified in the relevant order confirmation;


"Order confirmation” means the order confirmation document issued by us accepting and detailing your order for Products;

"Product” means encrypted video clips and multiple-choice questions or multiple-choice questions only and answers supplied under these Terms, as set out in an Order Confirmation (including any accompanying or ancillary materials supplied with such product); and

"we" / "us" / "our" / "Licensor" means Blue Light Publishing trading as Police Pass.

These Terms govern the agreement between us and you for the supply of Products to you, as set out in the order confirmation, for which we grant you a non-exclusive Licence to use such Products in accordance with the terms set out herein.

 

Part A - Our Supply of Products to You

1. Acceptance of Orders

An agreement is only made for the supply and use of Products when we accept your order and issue an Order Confirmation. Acknowledgement of receipt of orders will be given entirely at our discretion, but will not constitute acceptance.

  1. Cancellation of Orders

If you wish to cancel an accepted order you must provide us with notice in writing, to be received no less than 3 working days before the due despatch date. Otherwise you cannot cancel contracts for Products, and Products can only be rejected in the event of a defect as set out in Clause 8.

  1. Price

The price payable by you for Products shall be as agreed in the Licensor's published prices applicable at the time of despatch of the Product. Prices quoted do not include VAT and delivery costs (unless expressly stated).

  1. Payment

Payment for orders must be made at the time of placing the order, by a guaranteed method (for example, credit card).

We may, at our sole discretion, issue you with credit facilities when placing any order. Where credit is not offered you must pay the full price as set out in Clause 3 at the time of placing the order.

Where credit is offered, payment is due within 30 days of the date of our invoice, without any withholding, set-off or other deduction.

If you fail to make payment within 30 days of the invoice date, then, without prejudice to our other rights and remedies, we may suspend your Licence to use the Product until such time as payment is received. Interest will be due on all late payments, before as well as after judgment, at the rate of 1.5% per month.

No payment shall be deemed to have been received until we have received cleared funds.

  1. Delivery

Subject as set out in this Clause 5, and subject to your obligation to pay for Products as set out in Clause 4, we will use all reasonable endeavours to despatch Products on the agreed despatch date, to the address set out in the Order Confirmation. We may at any time notify you of delays in the despatch or delivery of Products, and may, at our discretion, amend the despatch or delivery dates accordingly. Under no circumstances shall time be considered of the essence in relation to despatch or delivery of Products.

You must notify us of late delivery or non-delivery before close of business on the working day immediately following the scheduled delivery date, failing which the Product will be deemed received at the date and time scheduled.

  1. Risk and Care of Product
     

Risk in Products shall pass on delivery.

  1. Product Warranties

Unless stated elsewhere in these Terms, Licensor makes no warranties or representations, either express or implied, in relation to any Product’s completeness, accuracy, quality (save as set out in Clause 8) or fitness for a particular purpose (whether advised to us or not).

In particular, you are fully responsible for ensuring that the format in which the Product is supplied is compatible with and suitable for use in conjunction with your computer or other relevant system and is otherwise fit for the purpose intended by you, and that it is suitably stored and maintained.

We shall not be liable for any losses, costs or expenses incurred by you through damage to your computer or any other system used by you (including without limitation any software or data stored on such system) or otherwise resulting from your failure to ensure such compatibility, suitability or fitness.

  1. Defective Products

You must notify us within 10 working days of the delivery date of any manufacturing defects in the media on which the Products are supplied, and promptly return such defective Products to us. We will replace, on a like-for-like basis, any such defective Products. You agree that this is your sole remedy in respect of defects in the Products.


Part B - Your Licence to Use the Products

9. Scope of Licence

Your Licence permits you alone to use and make use of the Product for your own personal training and development purposes.

You may not use the Products to educate, develop and train any other persons, including external third parties, without an appropriate licence from us. All rights not expressly granted to you in these Terms are reserved by us.

 Restrictions on Use

The Products contain the intellectual property of Licensor and/or one or more third parties, which is protected by law.

 You must not:

  • copy or duplicate a Product in whole or in part;
  • if any software is supplied as part of the Product, disassemble, decompile or reverse engineer the software;
  • translate, edit, amend, modify or add to a Product or incorporate it with other material; or
  • sell, rent, lend, give or sub-licence a Product (whether for reward or otherwise).
  1. Other Restrictions

You may only use a Product at any one time on a maximum of two devices for your own personal use.

You must not exhibit or disseminate a Product to others upon payment or otherwise by means of any LCD projector, television, terrestrial, satellite, cable or other broadcast or by any means of network or electronic transmission, without our written agreement.

  1. Term
     

Your Licence to personally use the Product shall continue for the fixed period stated in the order confirmation.

  1. Termination
     

We shall be entitled at any time (without prejudice to our other rights and remedies) to terminate your Licence if: (i) you commit a material breach of the Licence or these Terms; (ii) you go into liquidation or are the subject of any action or proceeding under bankruptcy or insolvency law (including the appointment of a receiver or administrative receiver); or (iii) your copy of the Product supplied becomes unfit for use whether through normal wear and tear or otherwise.

Please take special note that failure or success in a police exam / promotion process for any reason will not amount to a bona fide reason to terminate the licence. The refund policy outlined above is relevant in all other circumstances.

On termination or expiry of the Licence, howsoever caused, you shall (and shall ensure that your Permitted Users) shall cease to use or have access to the Products.

 Part C - General Terms About Our Relationship


14. Our Liability to You

Save in respect of (i) death and personal injury arising from the negligence of Licensor and/or its employees, (ii) fraudulent misrepresentation, and (iii) any other liabilities whose limitation is excluded or restricted by statute, our aggregate liability to you for all claims under this Agreement shall in no event exceed the total amount of sums paid by you in respect of the Product or Products giving rise to such claims.

We shall not be liable for any special, indirect or consequential loss or damage arising from or in any way connected with the supply, failure to supply, use of or inability to use a Product whether in contract, tort, negligence or under any statutory duty or otherwise including, without limitation, damages for loss of business profits, business interruption, loss of business information or any other pecuniary loss, even where we have been advised of the possibility of such loss or damage.

  1. Your Indemnity to Us

You agree to indemnify and hold us harmless against any cost, damage, loss, liability or expense arising out of the breach of the Licence or these Terms by you or any loss, damage, alteration or modification of the Product caused by you.

  1. Force Majeure

We will not be liable to you for any delay or non-performance of our obligations under these Terms, the Licence or otherwise arising from any cause or causes beyond our reasonable control including, without limitation, any of the following: war, riot, civil war, fire, flood, act of God, strikes, labour disputes, weather conditions, transport failure, pandemic or other disease.

  1. Performing Right Society
     

You will be responsible for acquiring any licences and paying any fees required by the Performing Right Society, Mechanical Copyright Protection Society or any other similar body arising from the exercise by you of your rights under this Licence.

  1. Restriction on Export

Save as otherwise permitted by law, you may not export the Product or view it outside the country to which it is initially delivered without our prior written consent.

  1. No Variation

These Terms apply to the exclusion of any conditions of business used by you or purported to apply under any purchase order or any other document issued by you, and to the exclusion of any written or oral representation made by any person before or at the time the contract is entered into, save as agreed in writing by a duly authorised officer of Licensor.

  1. Non-Transferability

The Licence is personal to you and your rights under these Terms may not be assigned, sub-licensed, transferred, alienated or shared in any way with any of your parent, subsidiary, holding, associated or related companies or any other third party without our express prior written consent.

  1. Third Party Rights

These terms shall not be enforceable under the Contract (Rights of Third Parties) Act 1999 by a third party, other than any owners of the intellectual property comprised in a Product.

  1. Governing Law

The construction, validity and performance of an Order Confirmation, a Licence and these Terms shall be governed by the laws of England and Wales and you and we each submit to the non-exclusive jurisdiction of the English courts.

PART D – SPECIAL TERMS WHEN YOU ORDER ONLINE

23. Using the on-line commercial facility on www.police-pass.co.uk

When you use www.police-pass.co.uk (the “Website”) to review Products and place orders the terms set out in this Part D will apply, in addition to Parts A, B and C of the Terms.

Information on the Website

Although we try to make sure that the prices quoted on the Website are accurate, and the Products have been fairly described, mistakes can happen. If after we receive your order we discover an error in pricing or a material error in the description of Products, we will inform you as soon as reasonably possible, and we will give you an option to reconfirm your order or to cancel. If we cannot contact you to advise of the error, or we do not receive a response from you within a reasonable time, we will treat the order as being cancelled. If the order is cancelled we will refund any money taken from you relating to the cancelled order.

  1. Products available on the Website

We reserve the right to remove any information or withdraw any Products on the Website at any time. All orders are subject to availability, and any statements as to availability or delivery times on the Website are estimates only.

  1. Placing an order on the Website

When you use the website to place an order you are making an offer to buy Products from us. We will acknowledge receipt of your order, but this will not constitute acceptance of your offer. Your offer is only accepted when we issue an Order Confirmation in which we specify that your order has been accepted and dispatched.

  1. Changes to these Terms

We reserve the right to change the terms under which the Website and the Products are offered for rental at any time. Any such change in terms and conditions will be effective once included in the text of these Terms as published on the Website. You should check the terms and conditions posted on the Website periodically to ensure that you are aware of and comply with the current version.
